Deepwhale provides a service that uses Artificial Intelligence to scan, analyze, and summarize publicly available data to generate business intelligence insights. The service is provided on an "as is" and "as available" basis. We reserve the right to modify or discontinue the Service at any time.

To access most features of the Service, you must register for an account. You agree to provide accurate, current, and complete information during the registration process. You are responsible for safeguarding your password and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.

4. Subscriptions and Payment

Our Service is billed on a subscription basis. By purchasing a subscription, you authorize us to charge your chosen payment provider. Subscriptions auto-renew at the end of each billing cycle unless cancelled. You may cancel your subscription at any time, but no refunds will be issued for partial subscription periods.

5. Data Usage and Sources

Our service relies exclusively on data that is publicly available. We do not access private or confidential information. You provide us with your "Company Profile" to allow us to tailor the search and analysis. You are responsible for the accuracy of the information you provide and grant us a license to use this profile data to provide the Service to you.

6. Intellectual Property

All rights, title, and interest in and to the Service itself (excluding user-provided content) are and will remain the exclusive property of Mingard Informatik. The insights, reports, and data compilations generated for you are for your internal business use only and may not be resold or redistributed.

7. Termination

You may terminate your account at any time. We may also suspend or terminate your account if you breach any of these Terms. Upon termination, your right to use the Service will immediately cease.

8. Disclaimers and Limitation of Liability

While we strive to provide accurate and timely information, we make no warranty that the service will be error-free or that the insights provided will be accurate or reliable. The information provided is not financial or legal advice. Mingard Informatik shall not be liable for any indirect, incidental, or consequential damages resulting from the use of the service.

9. Governing Law

These Terms shall be governed and construed in accordance with the laws of Switzerland, without regard to its conflict of law provisions. Any disputes will be resolved in the competent courts of Zurich, Switzerland.

10. Changes to Terms

We reserve the right to modify these terms at any time. We will provide notice of any significant changes by posting the new Terms on this page and, where appropriate, through email notification.
